Date of Occurrence: Housing Northwest Inc. v. American Insurance Co.
Oregon Court rules the term “occurred” was ambiguous as used in the subject insurance policy, which required an action be brought, “within two years after the date on which the direct physical loss or damage occurred.” The federal court ruled “occurred” could reasonably be interpreted to mean either the date when the policyholder discovered the damage or the date the damage began.
