Public Adjuster Services: National Fire Adjustment Co., Inc. v. Cioppa

The Federal District Court in Maine recently declared that Maine cannot enforce 24-A M.R.S. § 1476, which requires that public adjusters adhere to a 36-hour waiting period before soliciting business from Maine citizens or offering a contract for public adjustment services. The Court declared as unconstitutional, in violation of the Free Speech Clause, that portion of 24-A M.R.S. § 1476(1) that prohibits solicitation of public adjuster services.
